RE: The tariff classification of a lamp-holder from China.

Dear Mr. Montgomery:

In your letter dated September 2, 2011, you requested a tariff classification ruling on behalf of your client, Meico Lamp Parts Co., Inc.

The merchandise under consideration is a Lamp Holder, Item Number 22708ATR. Samples of the lamp-holder were submitted with your ruling request and will be returned to you. From the samples and information you provided, Item Number 22708ATR is a lamp-holder consisting of a porcelain housing measuring approximately ¾” long by ½” wide by ?” high with a socket specifically designed for a G4.0A Low-Wattage halogen lamp. It contains two 187 quick push-in terminals made of nickel coated phosphor. The socket end of the housing is covered with a mica plate, which has the pre-openings for the halogen lamp pin contacts. This lamp-holder is rated for up to 12 Volts (V).

The applicable subheading for the Lamp Holder, Item Number 22708ATR is subheading 8536.61.0000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for Lamp-holders, plugs and sockets: Lamp-holders.” However, lamp-holders of porcelain containing a socket are eligible for duty-free treatment under subheading 9902.23.30, HTSUS.

The applicable subheading for the Lamp Holder, Item Number 22708ATR, will be 9902.23.30, HTSUS, which provides for “Lamp-holder housings of porcelain, containing sockets (provided for in subheading 8536.61.00).” The general rate of duty will be Free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
